Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Huely mobile application ("Huely", "the app"), operated by Stratega (owner: Chris Guida) ("we", "us", "our"). Please read them carefully.
1. Acceptance of Terms
By downloading, installing, or using Huely, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the app. If you use Huely on behalf of someone else, you confirm you are authorized to accept these Terms for them.
2. Description of Service
Huely is a free, ad-supported color-perception game. Each day it presents a seeded daily challenge — a grid of tiles where one tile is a slightly different shade — along with an untimed Zen mode and a calendar to replay past days. The app tracks your streak and Color IQ locally on your device. Huely has no user accounts and no servers of its own; all of your game data is stored on your device.
3. License to Use Huely
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use Huely on devices you own or control, solely for your own personal, non-commercial entertainment, and in accordance with these Terms and the rules of the app store from which you obtained the app.
4. Acceptable Use
You agree not to:
- Copy, modify, reverse engineer, decompile, or disassemble the app, except to the extent permitted by law;
- Distribute, sell, sublicense, rent, or lease the app or any part of it;
- Use cheats, bots, automation, exploits, or any method to manipulate scores, streaks, or the daily challenge;
- Interfere with, disrupt, or attempt to gain unauthorized access to the app, its advertising systems, or any related services;
- Use the app for any unlawful purpose or in violation of any applicable law or regulation.
5. Advertising
Huely is free and supported by advertising. Ads are served by third-party providers, including Google AdMob, and may be personalized subject to your consent and device settings. We are not responsible for the content of third-party ads or for any products, services, or websites they link to. Your interactions with advertisers are solely between you and the advertiser. 6. Intellectual Property
Huely, including its name, logo, design, color systems, code, graphics, and all related content, is owned by Stratega and is protected by intellectual property laws. Except for the limited license granted above, nothing in these Terms transfers any ownership or rights to you. You may share screenshots of your results for personal, non-commercial purposes.
7. Disclaimers — "As Is"
Huely is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, secure, or that the daily challenge, scores, or streaks will always be available or preserved. You use Huely at your own risk.
8. Limitation of Liability
To the maximum extent permitted by law, in no event will Stratega, Chris Guida, or their affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data (including loss of streaks, scores, or history), profits, or goodwill, arising out of or related to your use of or inability to use Huely, even if advised of the possibility of such damages. To the extent any liability cannot be excluded, our total aggregate liability to you for all claims relating to the app will not exceed five U.S. dollars (US$5.00), reflecting that Huely is provided to you free of charge.
9. Indemnification
You agree to indemnify and hold harmless Stratega and Chris Guida from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the app or your violation of these Terms.
10. Changes to the App or Terms
We may update, change, suspend, or discontinue Huely or any of its features at any time without notice. We may also revise these Terms from time to time; when we do, we'll update the "Last updated" date above. Your continued use of the app after changes take effect constitutes your acceptance of the revised Terms.
11. Termination
You may stop using Huely at any time by uninstalling it. We may suspend or terminate your access to the app if you violate these Terms. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will continue to apply.
12. Governing Law
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law principles. You agree that any dispute arising from these Terms or your use of Huely will be subject to the exclusive jurisdiction of the state and federal courts located in California, to the extent permitted by applicable law.
13. App Store Terms
Your use of Huely is also subject to the terms of the app store from which you downloaded it (such as the Apple App Store or Google Play). In the event of a conflict between these Terms and the applicable app store terms regarding your use of the app on that platform, the app store terms will control to the extent of the conflict.
